Selling beauty products to your customers adds revenue to your bottom line. For all consumer products there is a risk of someone getting injured by it. This is particularly true for vitamins, creams, lotions, and other topical agents or take home devices. We can all agree that the manufacturer of the product should carry liability insurance. What most don't realize is that there are too many negative variables linked to the insurance policy of the manufacturer. In some cases, there is no insurance at all.
The product liability insurance rule: all parties in the chain of commerce are liable for the products they sell. A judge will typically split up the liability by assigning 50% of the liability share to the manufacturer and 25% each to the distributor and retailer.
Consider this: in criminal court your are innocent until proven guilty; in civil court you have to prove your innocence. At the end if you win, you loose, and if you loose, you still loose. In both situations, you will spend a significant amount of money defending yourself, yet the law does not provide a remedy to get reimbursement for your legal fees.
